END USER LICENSE AGREEMENT

Ebaazar agrees to provide the user ("USER") with a copy of this software product ("SOFTWARE"), and grants the USER a limited license to use the SOFTWARE. ("LICENSE") This LICENSE defines what the USER may do with the SOFTWARE, and contains limitations on warranties, liabilities and remedies. This LICENSE may be revoked by Ebaazar at any time without notice if the USER fails to comply with the terms of this LICENSE. The copyright and all other rights in the SOFTWARE shall remain with Ebaazar.

LICENSE OF UNREGISTERED SOFTWARE

An unregistered copy of the SOFTWARE ("UNREGISTERED SOFTWARE") may be used by the USER for evaluation purposes for a period of seven (7) days following the initial installation of the UNREGISTERED SOFTWARE. ("TRIAL PERIOD") At the end of the TRIAL PERIOD, the USER must either register the SOFTWARE or remove it from his system. The UNREGISTERED SOFTWARE may be freely copied and distributed to other users for their evaluation.

LICENSE OF REGISTERED SOFTWARE

A registered copy of the SOFTWARE ("REGISTERED SOFTWARE") allows the USER to use the SOFTWARE only on a single computer or network, and only by a single user at a time. If the USER wishes to use the SOFTWARE for more than one user, the USER will need a separate license for each individual user. The USER is allowed to make one copy of the REGISTERED SOFTWARE for back-up purposes.

TERM OF LICENSE

This LICENSE shall continue for as long as the USER uses the REGISTERED SOFTWARE and/or distributes the UNREGISTERED SOFTWARE according to the terms of this agreement. However, this LICENSE will terminate if the USER fails to comply with any of its terms or conditions. The USER agrees, upon termination, to destroy all copies of the REGISTERED and/or UNREGISTERED SOFTWARE. The limitations of warranties and liability set forth in this LICENSE shall continue in force even after termination.

ACCEPTANCE OF THIS LICENSE AGREEMENT

By downloading and/or installing this SOFTWARE, the USER agrees to the terms of this LICENSE.

DISCLAIMER OF WARRANTY AND LIABILITY

This SOFTWARE is provided "as is" without representations or warranties of any kind, whether expressed or implied. The USER must assume the entire risk of using the SOFTWARE, and Ebaazar shall have no liability to the USER or any other third-party for any damages whatsoever, including, but not limited to, any economic or data loss, even if such loss was foreseeable by Ebaazar.

Ebaazar DISCLAIMS ALL OTHER WARRANTIES, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO ANY WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE, WITH RESPECT TO THE SOFTWARE AND THE ACCOMPANYING WRITTEN MATERIALS. ANY LIABILITY OF Ebaazar WILL BE LIMITED EXCLUSIVELY TO PRODUCT REPLACEMENT OR REFUND OF ORIGINAL PURCHASE PRICE.

CHANNELS AVAILABILITY & QUALITY

NET TV is a media to play the worldwide channels available on internet.NET TV doesn't owns any channels by itself.The quality & availability of the channels depends on the source of the channels & not on NET TV software.The other factor which affects the availability & quality of the channel is ISP.Better internet connection gives better result.Hence eBaaZar doesn't gives any gurantee for channels availability & picture quality.

REFUND POLICY

As availability & quality of the channel depends on the channel source & not on the software,Refund will be made only if there is problem in the software.No refund will be given due to channel unavailability or user's poor internet connection.For more help refer FAQs.

Customers must make the refund claim within the first 30 days of purchase through our website URL only http://www.ebaazar.tv/moneyback.asp.There are no refunds after the 30-day period.In case of refund customer must agree to delete all refunded eBaaZar software from his/her computer, or any/all computers or servers where the software is installed.

NOTE: Charge backs to credit cards or stop payments on checks as a means to "return" software will be construed as fraud and prosecuted to the fullest extent of the law.

CONTENT

Data returned is collected by a process that uses common search engines to start with. Therefore, Ebaazar cannot screen sites for adult, infringing, illegal or otherwise questionable content. Ebaazar WILL NOT BE LIABLE FOR CONTENT ACCESSED WITH ITS SOFTWARE OR SERVICE. The user of the software or service is exclusively liable for any use or misuse of the data or content. Some software and services offered by Ebaazar provide links to multimedia files and webpage elements throughout the Internet. Ebaazar does not grant any license to use these files. If you wish to use any files you see during a search, you must either obtain permission from the owner or be sure that your use is a "fair use" under U.S. Copyright law.

MINORS

As with any search engine, please be aware that the software and related service may access areas on the Internet that contain adult or mature content. You must be at least 18 years of age to access and view such areas. If you view this adult content, we understand that you are telling us that you are at least 18 years old and that the material you are viewing is acceptable to you. With respect to general audience content, if Ebaazar learns that anyone under the age of 13 has accessed the software or service, Ebaazar will require verified parental consent, in accordance with the Children's Online Privacy Protection Act of 1998 ("COPPA").

OTHER RESTRICTIONS

The USER may not rent, lease, sublicense, translate, disassemble, reverse engineer, or de-compile the SOFTWARE, or modify or merge the SOFTWARE with any part of the software in another program. The USER may not pass to any other person or company user license codes, received from Ebaazar. This LICENSE may not be assigned or otherwise transferred without the prior written consent of Ebaazar. INVALID PROVISIONS If any provision of this LICENSE shall be declared invalid or unenforceable, the remaining provisions of this LICENSE shall remain in full force and effect to the fullest extent permitted by law. In such event, each provision of this LICENSE which is invalid or unenforceable shall be replaced with a provision as similar in terms to such invalid or unenforceable provision as may be possible which is legal and enforceable.

INDEMNIFICATION

You agree that You shall defend, indemnify, save and hold the Company harmless from any and all demands, liabilities, losses, costs and claims, including reasonable attorney's fees, asserted against Company, its agents, servants, officers and employees, that may arise or result from any provision of the Services to You or performed or agreed to be performed on your behalf or any product or service sold by You, your agents, employees or assigns through the use of the Services or in event of any contemplated or actual breach. Without limiting to what has been mentioned in the foregoing paragraphs, You agree to defend, indemnify and hold the Company harmless against liabilities arising out of any injury to person or property caused by any products sold or otherwise distributed in connection with the Services provided to You; any material supplied by You infringing or allegedly infringing on the property or proprietary rights of a third party; copyright infringement; and any defective product which You sold or distributed by means of the Services.

TITLE AND OWNERSHIP

Except to the rights, which are expressly granted in this License Agreement, You hereby understand and agree that there is no right transferred to you either in respect of the title to the Software or documentation or interest in the Software or the Documentation or any copyright to the software, or patent or trade secret or other intellectual property or proprietary rights in the Software or Documentation. The Company retains the sole and exclusive rights to the part or entire Software or Documentation and/or the copies thereof and You are obligated to assign all rights, title or interest in and to any modifications You effect to the Software or Documentation, whether or not such modifications are expressly permitted by the Company. The Software or the Documentation or the information contained in the Software is the property of the Company and You therefore hereby agree that You do not engage in unauthorized use or disclosure, which would harm the interests of the Company. Upon learning any unauthorized possession or use of or access to the Software and/or Documentation, You shall notify the Company immediately and shall furnish details of such an event and will assist the Company in preventing any recurrence thereof. You will also cooperate fully in any litigation or other proceedings undertaken by the Company to protect its rights thereto. Use of the whole or a part of the Software may attract the license or other fees to any third party, which You hereby agree to undertake the responsibility for and make payment of such incidental fees to the third party and that You shall not hold the Company responsible for the same.

JURISDICTION

You expressly agree that exclusive jurisdiction for any dispute in any way relating to your membership or Ebaazar resides in the courts of Surat the State of Gujarat. And you further agree and expressly consents to the exercise of person jurisdiction in the courts of Surat of the State of Gujarat in connection any such dispute including any claim involving Ebaazar or it affiliates, subsidiaries employees, contractors, officers direct telecommunication provides and content provides. You also expressly agree that notice given to Ebaazar will be by conventional mail. Notices to Ebaazar by conventional mail must be sent to Ebaazar postal address In any matter requiring Ebaazar a prior consent, such consent will be considered given only sent by conventional mail and signed by an authorized representative of Ebaazar.

ENTIRE AGREEMENT

This LICENSE is the entire agreement between Ebaazar and the USER, and supersedes any other agreement, oral or written, and may not be changed except by a written signed agreement.
